1. Scope
These Terms and Conditions apply to all services of the Cybernauten platform (“Provider”) towards entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) and legal entities under public law.
Use by consumers within the meaning of Section 13 BGB is excluded.
2. Platform purpose
Cybernauten operates a neutral decision and matching platform for IT security services.
The platform focuses on:
- structured presentation of IT security service areas,
- generation and forwarding of qualified requests (“leads”) to external IT security providers,
- provision of orientation and decision-support content.
Cybernauten is not a traditional IT security consulting or delivery company and does not replace individual security assessments or advice by specialized providers.
3. Matching of IT security services
Upon request, Cybernauten introduces contacts to external IT security providers (e.g., penetration testing, incident response, MDR, ISO consulting).
In this context:
- Cybernauten is not a contracting party between user and provider,
- Cybernauten assumes no liability for services, content, or results of the referred providers,
- contracts are concluded solely between the user and the provider.
Cybernauten owes no matching success.
4. Advisory services
In individual cases, Cybernauten may provide advisory services, in particular:
- assessment of security needs,
- structured preliminary analyses,
- decision and scope support,
- preparation of requests or tenders.
Advisory services are not legal, certification, or full IT security consulting and do not replace external expert reviews or audits.
If advisory services are provided for a fee, this is subject to a separate agreement.
5. Optional analysis and add-on services
Cybernauten may additionally offer automated analysis or assessment services (e.g., “security snapshots”).
These services:
- are based exclusively on publicly accessible information,
- are automated and non-invasive,
- are not penetration tests and do not provide security guarantees.
There is no entitlement to the execution or completeness of such add-on services.
6. User obligations
The user undertakes in particular to:
- provide only information they are authorized to use,
- not analyze or request third-party systems or data without authorization,
- not use the platform for unlawful purposes.
The user is solely responsible for the legal permissibility of their request.
7. Fees
7.1 Platform usage
Use of the platform for request and lead forwarding is generally free of charge for requesting users, unless explicitly stated otherwise.
7.2 Paid services
Paid services (e.g., advisory or add-on services) are listed and agreed separately.
8. Liability
Cybernauten is liable only for damages resulting from intentional or grossly negligent breaches of duty.
In cases of slight negligence, Cybernauten is liable only for breaches of essential contractual obligations and limited to foreseeable, typical damages.
Liability for:
- lost profits,
- indirect damages,
- consequential damages
is excluded to the extent permitted by law.
9. Availability
Cybernauten strives for high availability of the platform but does not guarantee uninterrupted use.
Maintenance, security measures, or technical disruptions may lead to temporary restrictions.
10. Usage restrictions
In particular, the following is prohibited:
- use of the platform for unlawful purposes,
- circumvention of technical protection measures,
- automated access without consent,
- abusive generation of requests.
In case of violations, Cybernauten reserves the right to block access or reject requests.
11. Privacy
Processing of personal data is carried out in accordance with the privacy policy on cybernauten.com.
12. Changes to the Terms
Cybernauten reserves the right to amend these terms if required for legal, technical, or content-related reasons.
13. Final provisions
German law applies.
Jurisdiction is the Provider’s registered office, to the extent permitted by law.
If individual provisions of these terms are invalid, the remaining provisions remain effective.
